Please read these Terms of Service (“Terms”) carefully before using omemeditation.org (the “Website”) or participating in programs and services offered by OME Meditation (Online Meditation Events Inc.) (“OME,” “we,” “us,” or “our”).

Conditions of Use

By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website accordingly. OME Meditation only grants use and access of this website and its services to those who have accepted its terms.

Program Etiquette

To participate in OME Meditation Programs we request respectful participation. Unsolicited, inappropriate, or offensive remarks will result in prompt removal from class. Participants try to personally contact our staff in an inappropriate manner will result in removal or expulsion from all OME Meditation Programs.

Program Access

Access to paid OME Meditation programs, Personal Guidance, and Membership sessions is limited to registered or authorized participants. Registration, Membership access, account credentials, and session links may not be shared with another person unless expressly permitted by OME Meditation.

OME Meditation reserves the right to verify participant access and remove individuals who are not registered or otherwise authorized to participate.

Free programs may allow registered participants to invite guests when expressly permitted by OME Meditation. Guest participation is subject to the registration and access instructions provided for the applicable program.

Recording of Free Programs

From time to time, portions of OME Meditation’s free meditation programs may be recorded for educational, informational, or promotional purposes. Participants will be informed when recording is taking place and may choose to turn off their camera if they do not wish to appear in the recording.

OME Meditation will obtain additional consent before intentionally featuring a participant’s name, personal story, testimonial, or other identifiable contribution in marketing or promotional materials.

To protect the privacy of participants and the integrity of the learning environment, participants may not record, capture, download, screen-record, photograph, or otherwise reproduce any OME Meditation program, session, breakout room, discussion, presentation, or participant contribution without prior written permission from OMEMeditation. This applies to all OME Meditation programs, including free classes, paid programs, Personal Guidance, Membership sessions, and special events.

Privacy Policy

Before you continue using our website, we advise you to read our privacy policy [1] regarding our user data collection. It will help you better understand our practices.

Counseling Services

OME Meditation’s Counseling Program is separate from OME Meditation’s meditation education and Personal Guidance services and may be subject to additional provider agreements, informed consents, privacy notices, cancellation policies, and other terms presented to participants when counseling services are requested or provided.

Counseling services are governed by the terms and policies applicable to those services, including any applicable Notice of Privacy Practices.

Modifications and Termination

OME Meditation reserves the right to do any of the following without notice: (1) to modify, suspend or terminate operation of or access to the website, or any portion of the website, for any reason; (2) to modify or change the website, or any portion of the website, and any applicable policies or terms; and (3) to interrupt the operation of the website, or any portion of the website.

OME Meditation may make changes to any services offered on the website, or to the applicable prices for any such services, at any time, without notice. The materials on the website with respect to services may be out of date, and OME Meditation makes no commitment to update the materials on the website with respect to such services.

Age Restriction

You must be at least 18 years of age before you can use this website. If you are a parent or guardian of a child under 18 years of age, you must be present and consent for your child’s use of this website. By using this website, you warrant that you are at least 18 years of age and you (and your child) must legally adhere to this Agreement. OME Meditation assumes no responsibility for liabilities related to age misrepresentation.

Intellectual property

You agree that all materials, products, and services provided on this website are the property of OME Meditation, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute OME Meditation’s intellectual property in any way, including electronic, digital, or new trademark registrations.

You grant OME Meditation a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.

Applicable Law

By visiting this website, you agree that the laws of the state of New York, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between OME Meditation and you, or its business partners and associates.

Disputes

Any dispute related in any way to your visit to this website or to our services shall be arbitrated by state or federal court in New York and you consent to exclusive jurisdiction and venue of such courts.

Indemnification

You agree to indemnify OME Meditation and its affiliates and hold OME Meditation harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Limitation on Liability

OME Meditation is not liable for any damages that may occur to you as a result of your use or misuse of our website.

OME Meditation reserves the right to edit, modify, and change this Agreement any time. This Agreement is an understanding between OME Meditation and the user, and this supersedes and replaces all prior agreements regarding the use of this website.

The information contained on the website is for general information purposes only.

OME Meditation assume no responsibility for errors or omissions in the contents of the website.

In no event shall OME Meditation be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the website or the contents of the website. OME Meditation reserve the right to make additions, deletions, or modifications to the contents on the website at any time without prior notice.

The Company does not warrant that the website is free of viruses or other harmful components.

Medical & Mental Health Disclaimer

OME Meditation’s meditation classes, Inner Clarity, Personal Guidance, Membership programs, educational materials, and other meditation offerings are intended for meditation education, self-reflection, and general well-being. They are not psychotherapy, counseling, medical treatment, psychiatric treatment, diagnosis, crisis intervention, or a substitute for professional healthcare.

Personal Guidance is a meditation education and self-reflection service and should not be understood as counseling or therapy.

If you have questions or concerns regarding your physical or mental health, please consult an appropriately qualified healthcare professional.

This disclaimer does not apply to professional counseling services offered through OME’s Counseling Program, which are governed by the terms, professional standards, privacy notices, and other policies applicable to those services.

Cancellation & Refund Policy

OME Meditation offers free programs as well as paid programs and services, including Inner Clarity, Personal Guidance, and OME Membership. Cancellation, refund, rescheduling, transfer, renewal, and pause terms vary depending on the program or service purchased.

Please review the applicable program policy before completing your purchase.

Inner Clarity

Cancellations made 7 or more days before the program begins are eligible for a full refund.

Cancellations made within 7 days of the program start date may be transferred to the next available cohort, subject to availability.

Once the program has begun, refunds are generally not available. If unexpected circumstances arise, please contact OME Meditation and we will do our best to help where reasonably possible.

Personal Guidance

Personal Guidance is available as either a Single Personal Guidance Session or a Three-Session Personal Guidance Package.

For a Single Personal Guidance Session, you may cancel before the scheduled session takes place and request a refund according to OME Meditation’s applicable refund procedures. Once the session has taken place, the payment is nonrefundable.

For a Three-Session Personal Guidance Package, you may cancel before the first session takes place. Once the first session has taken place, the package is considered to have begun and refunds are generally not available.

Personal Guidance is also subject to its applicable scheduling and rescheduling requirements. If exceptional circumstances arise, please contact OME Meditation. We will review the situation and do our best to help where reasonably possible.

OME Membership

OME Membership automatically renews according to the membership option selected—monthly, every three months, or annually—unless canceled before the next renewal date.

You may cancel future renewal before your next billing date. Cancellation prevents the next scheduled charge, and your Membership will remain active through the end of your current paid term.

Payments already processed for Monthly Membership are nonrefundable, including for unused days remaining in the current billing period. Once a 3-Month or Annual Membership term has begun, payments for that term are generally nonrefundable.

Eligible Memberships may be paused for up to three consecutive months within a 12-month period in accordance with the OME Membership Cancellation, Refund & Pause Policy.

If illness, family circumstances, or another significant situation affects your ability to continue your Membership, please contact OME Meditation. Exceptional circumstances may be reviewed individually.

Program-Specific Policies

The summaries above are provided for convenience. Each paid OME program or service may have additional requirements regarding cancellations, refunds, rescheduling, transfers, automatic renewals, pauses, attendance, or program completion.

The applicable program-specific policy presented at registration or purchase should be reviewed and accepted before completing your purchase.
